DURATION

This Agreement shall become effective on signing and shall remain in full force and effect until April 30, 2027 and shall continue from year to year thereafter, but should either party wish to change, add to, or amend this Agreement, it shall give notice in writing within sixty (60) days previous to April 30, 2027. When such notice is given, both parties shall convene a joint meeting within twenty-one (21) days of receipt of such notice. MULTIWORKS INCORPORATED (hereinafter called the “Employer” SHEET METAL WORKERS, AIR, RAIL AND TRANSPORTATION, LOCAL 512 —-SM (hereinafter called the “Union” WITNESSETH that for and in consideration of the mutual covenants hereinafter contained, the Employer and the Union hereby covenant and agree as follows: The employer hereby affirms, consents, agrees to and asserts voluntary recognition to the Union as sole and exclusive bargaining agent for all employees of the Employer, save and except the shop employees of the Employer, whenever such employees of such Employer are engaged in work in the construction industry/ accredited commercial and industrial sectors of the construction industry that falls within the jurisdiction of the Union as enumerated in the Collective Agreement between the Construction Labour Relations Association of Newfoundland and Labrador Inc., (“CLRA"), as Employer, and Sheet Metal Workers, Local 512, which Agreement is in effect between November 10, 2022 and April 30, 2027 and has been executed on or about November 13, 2022, and which Agreement may be amended from time to time by either/both the Union and CLRA. For the purposes of the Agreement, “Construction Industry” shall be as defined in the Labour Relations Act. R.S.N.L. 1990, c. L-1. The Employer further agrees to be bound by the Collective Agreement attached hereto as Schedule “A" and make all remittances pursuant thereto. The Employer and the Union further agrees when the Employer is not performing construction work as defined by Section 54(1) of the Labour Relations Act, the Employer agrees the following Collective Agreements will apply: 1. Maintenance Agreement effective October 25, 2023 to October 25, 2026 will cover all types of work referenced therein and. 2. National Maintenance Council for Canada Agreement will cover all types of work referenced therein. The Employer acknowledges receipt of all three Collective Agreements referred to in this VRA. 3. This Agreement shall be binding on the parties hereto and their respective successors and assigns. 4. This Agreement may be executed in one or more counterparts, each of which when so executed shall be deemed to be an original, and all of which together shall constitute one and the same instrument.
