PART V COMPENSATION AND RIGHT OF ACTION — Failure to give notice

Notwithstanding section 61, failure to give the notice or to make a claim or a defect or inaccuracy in the notice does not bar the right to compensation where, in the opinion of the commission, the failure, defect or inaccuracy was due to circumstances beyond the worker's control and the employer was not prejudiced by the failure, defect or inaccuracy.
