PART XXVIII GENERAL MINING REQUIREMENTS — Unventilated or unsafe mine area

(1) An employer shall ensure that a section of a mine that is not ventilated or maintained in a safe condition

is effectively barricaded to prevent inadvertent entry; and
523(b)
is posted with signs warning that entry is prohibited.

Before a person enters or is permitted to enter a section of a mine that is not ventilated or maintained in a safe condition, the employer shall ensure that the atmosphere is tested and conditions are examined by a competent person and hazard control measures are implemented prior to entry.
